These Terms & Conditions govern the use of gm-spike.com, the ordering of goods, payment, delivery, returns, and other related legal conditions for GM SPIKE 2 products and related offers.
1. General Terms
This agreement is a public offer and does not require signing. A public offer agreement has the same legal force as an agreement signed on paper.
The Seller carries out retail and wholesale sales of goods.
For the purposes of this Agreement, the design, appearance, and images of the product shown on the website are considered samples of the product.
The Seller reserves the right to make changes to these Terms & Conditions without prior notice to the Buyer.
2. Rights and Obligations of the Buyer
To place an order, the Buyer may be required to fill out the relevant form on the website. Registration is performed at the request of the Buyer where applicable.
The Buyer selects goods from the catalog of the online store https://gm-spike.com/ and submits the order to the Seller.
If the Buyer has any questions regarding the properties, characteristics, compatibility, or intended use of the goods, the Buyer may contact the Seller before placing an order.
The Buyer agrees to correctly specify their name, phone number, complete delivery address, and any other necessary contact details for order processing and delivery.
The Buyer agrees to accept delivery at the agreed address and within the agreed delivery timeframe where applicable.
The Buyer has the right to refuse the delivered goods. In the event of refusal, the Buyer may be required to reimburse the Seller for actual delivery and return transportation costs according to the rates of the courier or shipping service.
The Buyer should read the operating instructions before using the product.
If the Buyer requires clarification regarding the rules or conditions of using the product, the Buyer should contact the Seller for explanation.
The Buyer shall use the product in accordance with its intended purpose and follow all conditions, requirements, standards, and manufacturer recommendations stated in the operational documentation.
To prevent negative consequences related to product use, the Buyer shall follow the manufacturer’s safety recommendations and operating rules. If such rules are not included in the documentation, the Buyer shall follow the generally accepted safety conditions for this type of product.
In the event of a defect, the Buyer shall notify the Seller within 14 days from the date of delivery. To confirm the defect, the product may need to be submitted to the Seller for inspection or examination. If the defect is confirmed, the Buyer may be reimbursed for the full product price, including delivery costs where applicable. Claims submitted later than 14 days after delivery may be refused.
3. Rights and Obligations of the Seller
The Seller informs the Buyer about order acceptance by phone and/or e-mail and may clarify additional characteristics, product configuration, pricing, and delivery details.
The Seller undertakes to deliver the goods in accordance with the accepted order, in the quantity, price, and timeframe agreed with the Buyer.
The Seller guarantees that the appearance of the ordered products generally corresponds to the samples shown in the catalog. Minor differences in appearance, packaging, or accessories may be possible.
The Seller guarantees that the quality of the goods complies with the standards applicable to this type of product.
The Seller is not responsible for the accuracy and correctness of the information provided by the Buyer during registration or order placement.
The information provided by the Buyer is treated as confidential and is used solely for order processing, communication with the Buyer, delivery, payment processing, and related operational purposes.
4. Payment
Payment may be made by cashless payment in accordance with the agreed terms.
Online payment may be offered as a convenient way to make a quick remote payment. If available, the Buyer may select the online payment option during checkout or order confirmation.
5. Delivery
Orders are typically processed from 9:00 to 18:00, Monday to Friday. Saturday and Sunday are non-working days unless otherwise stated.
Orders may be accepted year-round for the range of products currently presented on the website.
After placing an order on the website, the Seller’s representatives may contact the Buyer within one hour or within several working hours to confirm and clarify the details.
Delivery of goods may be carried out by postal, transport, or courier companies.
Delivery time depends on the Buyer’s location and the chosen delivery method.
The Seller will make every reasonable effort to comply with the delivery times agreed with the Buyer. However, delivery delays may occur due to unforeseen circumstances beyond the Seller’s control.
6. Cost of Products
The current price of the product is indicated in the catalog of the online store https://gm-spike.com/.
The price of goods on the website may be changed by the Seller unilaterally. However, once an order has been confirmed, the price of the goods ordered by the Buyer is not subject to change unless otherwise agreed.
7. Return of Goods
The Buyer does not have the right to return goods of proper quality that belong to categories of products which, under applicable law, are not subject to return or exchange.
The Buyer may, within 14 days, return a product of proper quality provided that the product has not been used and its commercial condition, consumer properties, seals, factory packaging, and accompanying documents have been preserved.
Delivery of goods to the Seller for replacement or return is carried out by the Buyer unless otherwise agreed.
Product replacement or refund is only possible if all required conditions and procedures are fulfilled, including preservation of complete set, packaging, labels, barcodes, and absence of damage not related to manufacturing defects.
Return shipment of goods is carried out through postal or delivery services at the expense of the Buyer, unless the return or replacement is caused by confirmed inadequate quality of the goods, in which case the Seller may cover the return shipment.
If the purchased product is of proper quality and the Buyer accepted it at the point of issue or delivery but later decides within 14 days that the product is not suitable, then the return shipment and any related transfer fees are borne by the Buyer unless otherwise required by law.
In the case of a return, the refund is carried out by non-cash transfer to the Buyer’s account details within seven days from the date of receipt of the goods by the Seller, unless a different period is required by applicable law.
You may be refused a replacement product or a refund if:
- the product has no defects;
- the product is not new and shows signs of use;
- more than 14 days have passed since receipt of the product;
- inspection shows signs of outside interference, opening, attempted repair, or other warranty violations;
- there is no document confirming the purchase and/or the product set is incomplete.
General return and exchange conditions:
- returns and exchanges are possible within 14 days after the Buyer receives the goods, unless otherwise restricted by law;
- return delivery of goods is carried out at the expense of the Buyer, unless the return is caused by confirmed product defects;
- the Seller may refuse the exchange or return of goods of proper quality where such refusal is permitted under current legislation.
8. Other Conditions
All information provided by the Buyer to the Seller shall not be transferred to third parties for review or use, except with the Buyer’s written permission or where disclosure is required by local or international law and/or competent authorities in accordance with legal procedure.
In case of any questions or claims, the Buyer shall contact the Seller using any available communication method. The parties shall attempt to resolve all disputes through negotiations. If agreement cannot be reached, the dispute shall be referred to the competent judicial authority in accordance with applicable law.
